Vetting nursery workers: cutting through the confusion

Ask ten nursery managers what vetting checks they need to do, and you’ll get ten slightly different answers. Is the DBS Update Service mandatory or just recommended? Can you accept a DBS from another employer? Do agency staff need the same checks as permanent employees? What about volunteers?

If you’ve ever felt confused about what’s actually required versus what’s just “nice to have,” you’re not alone. The questions nurseries get wrong most often

Is the DBS Update Service mandatory?
Not mandatory, but strongly recommended by Ofsted. A point-in-time DBS tells you someone was clear at the date of issue — the Update Service tells you they’re clear now.
Can I accept a DBS from another employer?
Yes, if the person is subscribed to the Update Service and you check the certificate online. Without Update Service, you cannot rely on another employer’s DBS.
Do agency staff need the same checks as permanent staff?
The agency is responsible for vetting their workers, but you must see evidence of the DBS and right to work before they start. You cannot take this on trust alone.
What about EU and overseas qualifications?
You must obtain an official statement of equivalence from the DfE before counting these towards ratios. Missing this step is a common and costly compliance breach.

What Ofsted is actually looking for

Ofsted’s approach to safeguarding inspections has tightened significantly since the 2024 EYFS updates. Inspectors are looking for evidence that your vetting is current, complete, and documented — not just that it was done at some point in the past.
